If they are employed at a legal entity in EU\/EFTA only one month of previous employment is required.<\/p>\n<p>The 12 months requirement for outside EU\/EFTA comes from the <a href=\"https:\/\/www.seco.admin.ch\/seco\/en\/home\/Aussenwirtschaftspolitik_Wirtschaftliche_Zusammenarbeit\/Wirtschaftsbeziehungen\/Internationaler_Handel_mit_Dienstleistungen\/GATS_Allgemein.html\">GATS<\/a> agreement, which is valid for all <a href=\"https:\/\/www.wto.org\/english\/thewto_e\/whatis_e\/tif_e\/org6_e.htm\">WTO member states<\/a>. So, if a company expatriates an employee from a Non-WTO state this rule doesn\u2019t need to be applied and the 12 months previous employment should not be required.<\/p>\n<p><strong>Recommendation:<\/strong> Swiss cantonal offices may be strict about this 12 months requirement.
