Can Ukrainians with S status obtain a B permit in Switzerland?
There has been some confusion following statements from Swiss politicians regarding Ukrainian refugees being able to transition to a B permit in Switzerland.
Ukrainian refugees with an S status cannot initiate this change themselves; rather, it is the employer who must begin the process by proving a search. This means they need to be employed.
The proof of search requires the employer to advertise the job within the EU/EFTA for three months and to evaluate all applicants. If the employer is unable to find a suitable candidate during this period, they can justify hiring the Ukrainian refugee and obtain a new permit that is not classified as a refugee permit.
This process is recommended only for qualified personnel who hold an educational degree and have demonstrated experience.
It is important to note that cantonal requirements regarding salary may vary.
