New legislation concerning border procedures for Third Country Nationals

The EU has issued a decree which will impact the procedures on the external Schengen borders for Third Country Nationals who do not require a visa. The new legislation required for Switzerland as a result has already been approved by the Swiss Federal Council and is now released for consultation until May 21nd, 2018.

Up to date, the timely departure of such travelers has been checked manually by examining the stamps on the travel document. By 2021, the EU will have completed the introduction an information system (the so-called Entry/Exit-System EES) to replace this relatively unreliable control mechanism. The new system allows a precise and immediate identification of people who have not left the Schengen area within the officially required time frame.

The newly planned measures also include a facilitation of the entry and exit process for Third Country Nationals through an automatically processed border control and the opportunity to apply for an online pre-registration, particularly for frequent travellers.
